to support objections and appeals
All too often planning decisions are assessed on the subjective
opinion of the case officer. Our reports,
using accepted standards, help to remove the ‘guesswork’
from planning decisions.
Using the guidance laid down in the BRE guide, we are able to apply objective
tests to determine the impact a
development will have on a nearby property. We add weight to a planning
objection with a professional
report to the planning committee. If planning permission has already
been granted, then there may still be
a case to have the development altered or to demand compensation if
the legal right to light
is infringed.
Where a planning application has been turned down by a local planning
authority on the grounds of loss
of daylight or sunlight, we are able to undertake calculations to determine
whether refusal was well
founded. If the design satisfies the BRE requirements, we can put together
an appeal to have the
planning decision overturned. If the design fails the daylight or sunlight
requirements, we can advise on
the minimum cut back needed to make the development acceptable. We will
produce a report to back up
the revised planning proposal.
